Terms of Service

1. ACCEPTANCE OF THESE TERMS

These Terms of Service ("Terms") are a binding agreement between you and On Track GPS, LLC ("On Track GPS," "we," "us," or "our") governing your use of the On Track GPS mobile application and related services (together, the "Service").

By downloading, installing, or using the Service, you confirm that you have read and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Sections 8, 9, 10, 11, and 12 limit our liability and describe risks you accept by using the Service. Please read them carefully.

2. ELIGIBILITY

To use the Service you must be at least 13 years old. If you are under 18, you must have permission from a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

You must also be legally able to enter into a contract and not barred from using the Service under any applicable law.

3. YOUR ACCOUNT

You need an account to use the Service. You agree to provide accurate information and to keep it current.

You are responsible for keeping your password confidential and for everything that happens under your account. Tell us promptly at support@getontrackgps.com if you believe someone else has accessed it. We are not liable for losses caused by someone else using your credentials.

You may delete your account at any time in the App.

4. SUBSCRIPTIONS AND BILLING

4.1 Free Trial

New subscribers receive a 14-day free trial with full access. Unless you cancel before the trial ends, your subscription converts automatically to a paid subscription and your account will be charged.

4.2 Pricing

• Annual subscription (iOS): $29.99 per year
• Annual subscription (Android Early Access): $19.99 per year

Prices are in U.S. dollars and may differ by region. Apple and Google handle currency conversion, regional pricing, and applicable taxes.

4.3 Payment

All payments are processed by the Apple App Store or Google Play. We never receive your payment card or bank details. Your purchase is also subject to the terms of whichever store you bought through.

4.4 Automatic Renewal

Subscriptions renew automatically at the end of each term unless you cancel at least 24 hours before the term ends. Your account will be charged the then-current rate at renewal.

4.5 Cancellation

You can cancel at any time:

• iOS — Settings, then your name, then Subscriptions
• Android — Google Play Store, then Account, then Subscriptions

Cancellation takes effect at the end of your current billing period. You keep access until then. Deleting the App does not cancel your subscription.

4.6 Refunds

Refunds are handled by Apple and Google under their own policies. We cannot issue refunds directly. Request one through reportaproblem.apple.com or support.google.com/googleplay.

4.7 Price Changes

We may change subscription prices. Changes do not affect your current term. We will give you advance notice before a new price applies to a renewal, and you may cancel before it takes effect.

4.8 Android Early Access

The Android version of the Service is offered as an early access program at a reduced price while development continues. By subscribing to it, you acknowledge that:

• The Android version may have limitations the iOS version does not, particularly around background recording on certain manufacturers' devices
• Some Android devices aggressively restrict background applications, which can interrupt or degrade recording regardless of how the Service is built
• When the full Android version is released, early access subscribers will move to standard pricing at their next renewal, with advance notice
• Early access pricing is not guaranteed to continue

5. USING THE SERVICE

5.1 License

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use, subject to these Terms.

5.2 What You Agree Not to Do

You agree not to:

• Use the Service unlawfully or for any unlawful purpose
• Harass, threaten, or harm other users
• Attempt to access accounts, systems, or data that are not yours
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use bots, scrapers, or automated tools to access the Service
• Interfere with the operation or security of the Service
• Share your account with others or create multiple accounts to gain an advantage
• Impersonate another person or misrepresent your affiliation with anyone
• Use the Service commercially without our written permission

5.3 Activity Data Integrity

Squad competition depends on honest data. You agree not to submit activity records that do not reflect activity you actually performed. This includes using GPS spoofing tools, altering recorded data, transferring records between accounts, or misreporting pack weight to inflate a score.

We may remove activity records we reasonably believe to be falsified, and repeated or deliberate falsification is grounds for terminating your account without refund.

6. INTELLECTUAL PROPERTY

The Service — including its software, design, name, logo, and the method by which effort scores are calculated — is owned by On Track GPS, LLC and protected by intellectual property laws. These Terms grant you only the license described in Section 5.1.

You keep ownership of the content you create, including your activity records and squad names. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to store, process, and display that content as needed to operate the Service for you and, where applicable, for the squads you belong to.

If you send us feedback or suggestions, we may use them without obligation or compensation to you.

7. SQUADS

Squads let you compare effort scores with people you invite. Squads are private and are not published anywhere.

When you join a squad, other members can see your username or callsign, your effort scores, and your activity statistics. Squad codes are meant to be shared only with people you trust; we are not responsible for who gains access to a squad if you share its code.

You may leave a squad at any time.

8. WHAT THE SERVICE IS — AND WHAT IT IS NOT

Please read this section carefully. It defines the limits of what On Track GPS does.

On Track GPS is a record-keeping tool. It records where you went, how far, how much elevation you gained, how long it took, and how much weight you carried, and it turns those measurements into a proprietary effort score for comparison against your own history and against squads you join.

That is the whole of what it does. Specifically:

8.1 It Is Not a Navigation Product

Do not use the Service to find your way.

The Service does not provide routing, turn-by-turn directions, trail data, waypoints, or any guidance about where to go or how to get back. The map displayed in the App is third-party imagery provided for reference only. It may be outdated, incomplete, or unavailable, and it may not load at all where you have no cellular data connection.

The line the Service draws is a record of where you have already been. It is not a route, not a recommendation, and not a way home.

Anyone traveling in remote or backcountry terrain should carry appropriate navigation tools — a physical map, a compass, and where appropriate a dedicated GPS unit — and the knowledge to use them. The Service is not a substitute for any of these.

8.2 It Is Not a Safety or Emergency Device

The Service cannot summon help. It has no SOS function, no emergency beacon, no check-in feature, and no ability to transmit your location to emergency services or to anyone else.

If you travel where help is not readily available, carry a dedicated emergency communication device such as a satellite messenger or personal locator beacon, and tell someone your plans before you leave.

8.3 It Is Not a Fitness, Training, or Medical Product

The Service does not provide fitness instruction, training plans, coaching, nutritional guidance, or medical advice, and nothing in it should be treated as any of those things.

Effort scores are a proprietary comparison metric of our own design. They are not calories, not a measure of physiological load, not a clinical or scientific measurement, and not validated against any medical or fitness standard. They exist to let you compare one outing to another and to compare against your squad. Do not use them to make decisions about your health, training load, recovery, or medical care.

Consult a qualified physician before beginning any new physical activity, before carrying weight during activity, and before increasing the intensity or duration of what you already do.

8.4 It Does Not Show Land Ownership or Boundaries

The Service does not display property lines, public land boundaries, easements, access points, closures, or any other information about who owns the ground you are standing on or whether you are permitted to be there. See Section 10.

9. ASSUMPTION OF RISK

Hiking, rucking, hunting, climbing, and backcountry travel are inherently dangerous. By using the Service in connection with any such activity, you acknowledge and voluntarily assume all risks involved, including but not limited to:

• Physical injury, including injury caused or worsened by carrying weight
• Cardiac events, heat illness, hypothermia, dehydration, altitude sickness, and other medical emergencies brought on by exertion or exposure
• Falls, terrain hazards, avalanche, rockfall, and water hazards
• Severe weather, darkness, and rapidly changing conditions
• Encounters with wildlife
• Becoming lost, stranded, disoriented, or separated from your party
• Equipment failure, including failure of your phone, its battery, or its GPS receiver
• Loss of cellular or GPS signal
• Injury or death

You are solely responsible for your own safety, for assessing your own fitness and ability, for your equipment and preparation, for the decisions you make in the field, and for the safety of anyone with you.

You agree that On Track GPS is not responsible for any injury, illness, death, loss, or damage arising from any activity you record or attempt to record using the Service — including any injury or medical condition arising from physical exertion, and including becoming lost, stranded, or injured while relying on the Service.

10. LOCATION, LAND ACCESS, AND LEGAL COMPLIANCE

You are solely responsible for knowing where you are and for having the legal right to be there.

The Service records your position. It does not tell you who owns that position, whether you are permitted to be on it, or what rules apply to it.

Before and during any activity, you are responsible for:

• Determining whether the land you are on is public or private
• Obtaining permission from the landowner before entering private property
• Knowing and observing property boundaries, easements, and rights of way
• Complying with all applicable federal, state, tribal, provincial, and local laws, including trespass laws
• Knowing and following the rules of any public land you use, including designated closures, seasonal restrictions, permit requirements, motorized-use restrictions, and travel management rules
• Holding any license, tag, permit, or authorization required for your activity, including hunting and fishing licenses where applicable
• Complying with all hunting, fishing, and wildlife regulations that apply to where you are and what you are doing

Recording an activity through the Service is not evidence that you were lawfully present anywhere, and it does not grant, imply, or confirm any right of access.

On Track GPS accepts no responsibility for trespass, citations, fines, prosecution, civil claims, loss of privileges, or any other consequence arising from where you choose to go or from your compliance or non-compliance with any law or regulation.

11. DISCLAIMERS

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or that any defect will be corrected.

Accuracy. We do not warrant the accuracy, completeness, or reliability of any data the Service records or displays. GPS accuracy varies with your device, satellite geometry, terrain, tree cover, weather, and how you carry your phone. Distance, elevation, speed, and effort scores are estimates and will contain error.

Availability of recording. Recording depends on your device's operating system continuing to allow the Service to run in the background. Some manufacturers restrict background applications aggressively, and your device may pause, delay, or stop recording for reasons outside our control — including battery-saver settings, system memory pressure, and manufacturer power management. Recording may also stop if your battery dies, your device fails, or your device is damaged or lost.

Third-party content. Map imagery is provided by a third party and may be outdated, inaccurate, incomplete, or unavailable.

12. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, ON TRACK GPS, LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES
• LOST PROFITS, LOST DATA, OR LOSS OF USE
• PERSONAL INJURY, ILLNESS, OR DEATH
• PROPERTY DAMAGE OR LOSS
• ANY DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE
• ANY DAMAGES ARISING FROM INACCURATE, INCOMPLETE, INTERRUPTED, OR LOST RECORDING

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) TWENTY-FIVE U.S. DOLLARS.

THESE LIMITS APPLY REGARDLESS OF THE LEGAL THEORY — CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE — AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow certain warranty exclusions or liability limitations. Where that is the case, the exclusions and limits above apply to the fullest extent the law allows, and nothing in these Terms limits liability that cannot lawfully be limited.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless On Track GPS, LLC and its members, officers, employees, contractors, and agents from any claim, demand, liability, damage, loss, or expense (including reasonable attorneys' fees) arising out of:

• Your use or misuse of the Service
• Your breach of these Terms
• Your violation of any law or of any third party's rights, including any claim of trespass
• Any activity you undertake in connection with the Service, including any injury sustained by you or by anyone with you

14. TERMINATION

You may stop using the Service and delete your account at any time.

We may suspend or terminate your access, with or without notice, if you breach these Terms, if we suspect fraud or falsified data, if required by law, or if we discontinue the Service.

If we discontinue the Service entirely, we will give reasonable notice and will not charge you for any period after it becomes unavailable.

On termination, your license ends immediately and we may delete your data as described in our Privacy Policy. Sections 6, 8, 9, 10, 11, 12, 13, and 15 survive termination.

15. DISPUTE RESOLUTION AND GOVERNING LAW

15.1 Talk to Us First

Before starting any formal proceeding, you agree to contact us at support@getontrackgps.com and give us 60 days to try to resolve the dispute informally. Most problems can be sorted out this way.

15.2 Governing Law

These Terms are governed by the laws of the State of Montana, without regard to its conflict of laws rules.

15.3 Venue

Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Montana, and you consent to the personal jurisdiction of those courts. This does not deprive you of the protection of mandatory consumer laws in your country of residence.

16. CHANGES TO THESE TERMS

We may update these Terms. When we do, we will revise the "Last Updated" date and post the new version in the App. If the changes are material, we will give notice by email or through an in-App notice before they take effect.

Continuing to use the Service after an update takes effect means you accept the revised Terms. If you do not accept them, stop using the Service and cancel your subscription.

17. APPLE APP STORE

If you obtained the Service through the Apple App Store, the following also applies:

• These Terms are between you and On Track GPS, LLC only, not Apple.
• Apple has no obligation to provide maintenance or support for the Service.
• If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price if applicable. Apple has no other warranty obligation.
• Apple is not responsible for addressing any claim relating to the Service, including product liability, regulatory compliance, or consumer protection claims.
• Apple is not responsible for investigating, defending, or resolving any third-party intellectual property claim relating to the Service.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

18. GOOGLE PLAY

If you obtained the Service through Google Play, your use is also subject to the Google Play Terms of Service, and Google handles payment and refunds for that purchase.

19. GENERAL

Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Service.

Severability. If any provision is held unenforceable, the rest remains in effect and the unenforceable provision is modified to the minimum extent necessary.

No waiver. Our failure to enforce any provision is not a waiver of it.

Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.

Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
